All Users and Clients of BirdPASS are invited to read the data privacy policy on the site.

The Publisher of the site is the simplified joint-stock company Netpartage, with a capital social of €55,000, headquartered at 15 rue Paul Eluard - 76290 Montivilliers, France - Telephone : (+33) 09.66.83.33.91 - E-mail :contact@birdpass.fr, registered at the Commercial Court of Le Havre under number 431 642 651, having as VAT intracommunitaire number FR-81 431 642 651 and referred to as « BirdPASS » or the « Publisher ».

Any eligible natural or legal person wishing to access the BirdPASS internet site https://www.birdpass.fr is referred to as the « User ».

Preamble

BirdPASS respects the privacy of its Users. The confidentiality of data is important when BirdPASS offers its service allowing for the ordering of digital products and services, also known as dematerialized or numeric products. In order to enable the functioning of its internet site, as well as the sale and delivery of products and services, BirdPASS collects and processes various personal data. In this context, the User is informed of the following elements :

1. Purpose of collecting and processing data

The BirdPASS site proceeds to the collection and processing of personal data related to the User in order to enable the User to access their Member space, make purchases of products and services offered on the site, process and deliver orders to the email address indicated, establish invoices corresponding thereto, send news about the site to the User by email, as well as ensure the identity of the User and the security of payment operations to prevent any fraud or abuse. The personal data of the User are collected solely for the execution of the sales contract and with the consent of the User.

2. Data collected

BirdPASS collects data at different times on the site : when creating an account, when modifying an account, during product orders, during verification procedures, during connections to the site and during communications with our services.

The data collected includes : name, first name, postal address, email address, phone number, date of birth, identification documents, link to the site from which the User arrived, IP addresses during navigation, transaction information, completed orders.

The User provides this data knowingly, particularly when entering it themselves. It is then specified to the User whether or not they are required to provide these data.

For the needs of its services and in particular to facilitate their proper functioning, BirdPASS uses a cookie system. You will find information about this on our Cookies page.

Payment processing for products is handled by third-party operators with whom BirdPASS works. These operators collect financial data to complete transactions. These service providers apply their own conditions that the User must accept and they guarantee the confidentiality and security of financial information transmitted.

3. Data Controller

The data controller is the Publisher, in the sense of the French Data Protection Act and as of May 25, 2018, the General Data Protection Regulation (GDPR) on personal data.

4. Recipients of Data

Personal data is reserved for the exclusive use of the Publisher and its employees. Certain data may be transmitted to partners (email routing, payment operators) in order to enable service provision.

5. Data retention period

The data retention period is the time allowed for commercial use of the services on the site by the User, as well as the time allowed for contractual liability applicable to the Publisher. Data necessary for compliance with a legal obligation are retained in accordance with current regulations.

6. Security of data

The Publisher implements organizational, technical, software and physical measures for digital security to protect personal data against alterations, destructions and unauthorized access. However, it should be noted that the internet is not a completely secure environment, and the site cannot guarantee the security of transmission or storage of information on the internet.

7. Rights of individuals whose data is collected

In accordance with applicable regulations regarding personal data, BirdPASS site users have the following rights :

These rights, provided they do not contradict the purpose of processing, can be exercised by logging into theiraccount personal account or by submitting a request via postal mail to the data controller whose contact information is listed above. The data controller must respond within a maximum period of one month. In case of refusal to grant the user's request, it must be motivated. The user is informed that in case of refusal, they may file a complaint with the CNIL (3 place de Fontenoy, 75007 PARIS) or an authority of control.

The user may be invited to check a box indicating their acceptance of receiving informative and promotional emails from the site. They will always have the option to withdraw their consent at any time by following the unsubscribe link indicated at the end of the email.
